2. Description of Service

ProspectFlow is a SaaS platform that helps web designers, agencies, and freelancers generate leads by creating AI-powered websites for local businesses and producing personalized outreach materials. The Service includes business data research, website generation, website hosting on subdomains, contact discovery, and outreach content generation.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Subscriptions and Payment

Some features of the Service require a paid subscription. By subscribing, you agree to pay the fees associated with your chosen plan. Subscriptions are billed monthly and renew automatically unless cancelled. You may cancel your subscription at any time from your account settings. Refunds are handled on a case-by-case basis.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Send spam, unsolicited bulk messages, or harassing communications using outreach materials generated by the Service
  • Impersonate another person or business or misrepresent your affiliation
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service to create websites that infringe on intellectual property rights
  • Resell or redistribute the Service without authorization
  • Interfere with or disrupt the integrity or performance of the Service

6. Generated Content

Websites and outreach materials generated by the Service are created using AI and publicly available business data. You are responsible for reviewing all generated content before using it in outreach or sharing it with third parties. We do not guarantee the accuracy, completeness, or suitability of generated content.

Generated websites are hosted on ProspectFlow subdomains. We reserve the right to remove hosted content that violates these terms or applicable laws.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by ProspectFlow and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of the data you input into the Service. You grant us a license to process that data solely to provide the Service to you.

8. Compliance with Communication Laws

You are solely responsible for ensuring that your use of outreach materials generated by the Service complies with all applicable laws, including but not limited to CAN-SPAM, GDPR, TCPA, and any local regulations governing commercial communications. ProspectFlow provides tools to assist your outreach — how you use them is your responsibility.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROSPECTFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may close your account at any time. Upon termination, your right to use the Service ceases immediately, and hosted websites may be removed.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting updated terms on this page. Continued use of the Service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
